Abstract

This research examines the reconstruction of ethical code enforcement for election organizers in Indonesia through the perspective of prophetic law, arguing that ethical adjudication should extend beyond procedural compliance by integrating humanization, liberation, and transcendence as normative foundations of substantive justice. Employing doctrinal legal research, the study uses statutory, conceptual, case, and comparative approaches. It compares Indonesia's regulatory framework with the ethical governance systems of India and the United States to identify institutional models that strengthen integrity while respecting distinct constitutional traditions. The findings demonstrate that ethical adjudication differs fundamentally from administrative law: it governs the forum internum of election organizers, encompassing integrity, morality, and ethical responsibility, whereas administrative sanctions regulate the forum externum, concerning legal rights, obligations, and official actions. Subjecting ethical decisions to administrative judicial review therefore creates conceptual inconsistency by conflating distinct normative domains. The prophetic law paradigm provides a framework for ethical adjudication by requiring a balance between legal certainty, moral responsibility, public accountability, and spiritual integrity. Comparative analysis shows that India's Model Code of Conduct promotes electoral ethics, while U.S. ethics oversight highlights the importance of institutional independence. The study proposes a specialized Ethics Court or Ethics Council as the final appellate institution for DKPP decisions and recommends amendments to Law No. 7 of 2017 and Supreme Court Circular No. 10 of 2020 to protect ethical autonomy. This reconstruction harmonizes law, morality, and spirituality while strengthening electoral integrity and public legitimacy.
